1. General Provisions
These General Terms and Conditions of Sale (hereinafter referred to as the “General Terms”) apply to all services and products provided by Swiss Personal Training.
2. Services Offered
Swiss Personal Training offers the following services:
- Personal Training
- Boxing
- Ashtanga and Myo-Fascial Yoga
- Senior Coaching
- Ketogenic Nutrition
- Therapeutic Massage
- In-Office Osteopathy
- Foot Biomechanics
Other services may be added to this list.
3. Partnership Management and Prohibition of Circumvention
Clients and coaches must exclusively use the Swiss Personal Training platform to manage their partnership. Any attempt to circumvent the platform’s operation by arranging directly with the coach is strictly prohibited. Outside the platform, no protection or guarantee will be provided to the client.
4. Payment and Session Packages
Clients have the option to purchase session packages via an online Stripe link. The number of sessions and the validity period vary depending on the chosen package.
Commitment and Payments:
- The purchase of a package via Stripe commits the client. The full amount is due at the time of purchase. By checking the box “I accept the General Terms and Conditions” during payment, the client acknowledges having read and accepted these details and conditions.
Invoicing:
- An invoice is automatically generated and sent to the client by email following their payment.
5. Payment Security
To ensure the security, efficiency, and transparency of transactions on our platform, we use Stripe as our payment partner. Stripe is recognized for its strict adherence to security and compliance standards:
- PCI DSS (Payment Card Industry Data Security Standard): Protecting cardholder data against theft.
- TLS (Transport Layer Security): Ensures that data sent between the user’s browser and the website server remains private and secure.
- 3D Secure: Additional security measure for online credit card transactions.
6. Refund and Cancellation Policy
Refunds:
- In the event of relocation to another canton or outside Switzerland, a refund is possible upon presentation of an official declaration.
- In the event of a serious or disabling illness making physical activity unadvisable, a refund will be granted upon presentation of a medical certificate or a Swiss equivalent.
- In case of disagreement with a coach, it is possible to transfer the remaining sessions to another coach on the platform.
Cancellations:
- Cancellations less than 48 hours in advance: the session will be charged, unless the respective schedules of the client and coach allow it to be rescheduled before the end of the validity period.
7. Privacy Policy
Swiss Personal Training is committed to ensuring the protection of your privacy. The data collected includes:
- First and last name
- Company name (if applicable)
- Address
- Email address
- Phone number
- Payment information
The information collected allows us to improve our services, conduct marketing campaigns, enhance our website, and efficiently manage client accounts. Data is protected by physical, electronic, and management security measures.
8. Management of Payment Information
Payment information can be managed via the account area on the website. This area is accessible via a human-shaped icon located in the header next to the “Contact” button.
9. Warranty and Liability
Swiss Personal Training services include one free session for any session package purchase. We disclaim all liability for injuries resulting from the use of our services, except in cases of proven negligence on our part.
10. Copyright and Intellectual Property
All content on the site, including, but not limited to, graphics, images, texts, videos, animations, sounds, logos, GIFs, and icons, as well as their layout, are the exclusive property of Swiss Personal Training, with the exception of trademarks, logos, or content belonging to other partner companies or authors. Any reproduction, representation, or use without prior authorization is prohibited.
11. Force Majeure
In the event of force majeure (such as illnesses, natural disasters, strikes, acts of terrorism, wars, etc.), Swiss Personal Training shall not be held liable for any delay or failure to provide its services.
12. Amendments to the General Terms and Conditions
Swiss Personal Training reserves the right to amend the General Terms and Conditions at its discretion and without prior notice. These amendments will be effective from the date indicated. It is the clients’ responsibility to regularly consult this page to stay informed of any potential changes. Continued use of Swiss Personal Training’s services after the implementation of these amendments will constitute acceptance thereof.
13. Governing Law and Jurisdiction
These General Terms and Conditions are governed by Swiss law. In the event of a dispute, the competent courts will be those of the Canton of Vaud, subject to an appeal to the Swiss Federal Supreme Court.
